USITC Announces Investigations For Canon and HP

New York, NY – The United States International Trade Commission (USITC) announced on 28 July investigations on behalf of Canon and HP. We originally mentioned the lawsuit back in June. This most recent lawsuit is not the first time Canon has fought with Ninestar over patents.

In HP’s case, the action also began in June, though a few days earlier on the 25th. Their fight is with Mipo Technology and Mextec. This litigation is in relation to inkjet container patents.

For both Canon and HP, their complaints revolve around section 337 of the Tariff Act of 1930 which relates to the importing of goods into the United States. Also, both Canon and HP are alleging that these companies infringed on their existing patents.

According to The Recycler, the USITC has stated that “‘not yet made any decision on the merits of the case. The USITC's Chief Administrative Law Judge will assign the case to one of the USITC's six administrative law judges who will schedule and hold an evidentiary hearing’”. The USITC pledges to act as swiftly as possible and will set a date to complete the investigation “within 45 days after institution of the investigation.”
